Terms of Service

These Terms of Service ("Terms") govern your access to and use of CanadaWaterDamage247(the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

What we are

CanadaWaterDamage247 is an independent referral service operating in Canada that connects Canadian homeowners with licensed and insured water damage restoration contractors in their geographic area. We are not a restoration contractor and do not perform restoration services directly.

Service is offered in English-speaking Canadian provinces (BC, AB, MB, SK, ON, NB, NS, PE, NL, YT). Service is not available in Quebec, Northwest Territories, or Nunavut at this time.

What we are not

  • We are not a contractor; we do not perform restoration, demolition, drying, or any other work
  • We are not an insurance carrier, broker, or adjuster, and we do not provide insurance advice
  • We do not warrant or guarantee any work performed by contractors in our network
  • We do not independently verify contractor licensure, insurance, certifications, or qualifications. The homeowner is responsible for verifying these directly with the contractor
  • We do not provide legal advice

Independent contractor relationships

All contractors in our referral network are independent businesses. They set their own pricing, scheduling, estimate fees, warranty terms, and scope of service. Any agreement, contract, or transaction you enter into with a contractor is solely between you and that contractor.

CanadaWaterDamage247 does not employ any contractor, does not control their work, and is not responsible for their conduct, performance, failures, or breaches of contract. Disputes between homeowners and contractors must be resolved directly with the contractor.

Estimates, hours, and licensure

Initial assessments are typically offered without charge by most contractors in our network. Complex situations such as engineering reports, mould lab analysis, or third-party assessments may incur a fee that should be disclosed upfront by the contractor.

While many network contractors offer around-the-clock emergency response, specific availability and response times vary by area and contractor. Contractors are represented as licensed and insured by themselves; CanadaWaterDamage247does not independently verify each contractor's licensure or insurance status. Homeowners should request and verify documentation directly before authorizing work.

User obligations

By using the Service, you agree:

  • To provide accurate, current, and complete information when submitting requests
  • Not to use the Service for any unlawful purpose or in any way that violates these Terms
  • Not to interfere with the operation of the Service or attempt unauthorized access
  • To verify contractor licensure and insurance before authorizing any work
  • To resolve any disputes with contractors directly with that contractor

Intellectual property

All content on the Service (text, graphics, logos, code) is owned by CanadaWaterDamage247 or its licensors and is protected by Canadian and international copyright and trademark laws. You may not reproduce, modify, distribute, or use the content without express written permission, except for personal, non-commercial use.

References to third-party brands (insurance carriers, certifications, manufacturers, government programs) are made under nominative fair use principles for identification and educational purposes only and do not imply endorsement by or affiliation with those brands.

Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that information presented is accurate or current. Information about insurance coverage, contractor qualifications, or industry standards is provided for general guidance only and does not constitute professional advice.

All persons depicted in photos or videos on this site are actors or models and not contractors listed in our network.

Limitation of liability

To the maximum extent permitted by Canadian law, CanadaWaterDamage247 is not liable for:

  • Any work performed (or not performed) by a contractor in our network
  • Any damages, losses, or expenses arising from your use of the Service or interaction with a contractor
  • Indirect, incidental, special, consequential, or punitive damages
  • Any decision you make about pricing, scope of work, insurance claims, or contractor selection

Some Canadian jurisdictions do not allow certain limitations of liability, in which case those limitations apply only to the extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (such as fraud or gross negligence).

Indemnification

You agree to indemnify and hold CanadaWaterDamage247 harmless from any claim, damage, or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your interaction with a contractor.

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes our collection, use, and disclosure of personal information in accordance with PIPEDA, CASL, and applicable provincial privacy laws.

Modifications to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be communicated by a prominent notice on our homepage and by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Provisions of these Terms that by their nature should survive termination (including limitations of liability, indemnification, governing law) will survive.

Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal Canadian laws, without reference to conflict-of-laws principles. Disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Ontario, except where mandatory provincial consumer protection law gives a homeowner the right to bring an action in their home province.
